The Supreme Court (SC) clarified the application of lascivious conduct under Republic Act (RA) No. 7610, or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act, in relation to acts of lasciviousness under the Revised Penal Code (RPC).

In a Decision written by Associate Justice Henri Jean Paul B. Inting, the SC En Banc upheld Jeffrey L. Gramatica’s (Gramatica) conviction for lascivious conduct under Section 5(b) of RA 7610, but modified XXX2660399’s conviction to acts of lasciviousness under Article 366 of the RPC. The SC laid down guidelines to ensure the proper prosecution of cases under these two distinct laws.
